This Privacy Policy applies to all personal information collected by PARTLYCLOUDY.AI PTY LTD (we, us or our) via the website located at https://dashboard.partlycloudy.ai (Website) and via the PartlyCloudy mobile application available on Google Play and the Apple App Store (App).
1. What information do we collect?
The kind of Personal Information that we collect from you will depend on how you use the Website and the App. The Personal Information which we collect and hold about you may include:
- Login credentials
- Email address
- Name
- Phone number
- Location data
- Device identifiers
Location data is collected only through the App, only with your permission, and is described in detail in section 5 below.
2. Types of information
The Privacy Act 1988 (Cth) (Privacy Act) defines types of information, including Personal Information and Sensitive Information.
Personal Information means information or an opinion about an identified individual or an individual who is reasonably identifiable:
- whether the information or opinion is true or not; and
- whether the information or opinion is recorded in a material form or not.
If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as “Personal Information” and will not be subject to this Privacy Policy.
Sensitive Information is defined in the Privacy Act as including information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Sensitive Information will be used by us only:
- for the primary purpose for which it was obtained;
- for a secondary purpose that is directly related to the primary purpose; and
- with your consent or where required or authorised by law.
3. How we collect your Personal Information
We may collect Personal Information from you whenever you input such information into the Website or the App, or provide it to us in any other way. Where you grant the App permission to access your device's location, we collect location data from your device as described in section 5.
We may also collect cookies from your computer which enable us to tell when you use the Website and also to help customise your Website experience. As a general rule, however, it is not possible to identify you personally from our use of cookies.
We generally don't collect Sensitive Information, but when we do, we will comply with the preceding section.
Where reasonable and practicable we collect your Personal Information from you only. However, sometimes we may be given information from a third party. In cases like this we will take steps to make you aware of the information that was provided by a third party.
4. Purpose of collection
We collect Personal Information to provide you with the best service experience possible on the Website and the App - including delivering severe-weather safety alerts, and keep in touch with you about developments in our business.
We customarily only disclose Personal Information to our service providers who assist us in operating the Website and the App. Your Personal Information may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties.
By using our Website or the App, you consent to the receipt of direct marketing material. We will only use your Personal Information for this purpose if we have collected such information directly from you, and if it is material of a type which you would reasonably expect to receive from us. We do not use sensitive Personal Information in direct marketing activity, and we never use your location data for direct marketing or advertising. Our direct marketing material will include a simple means by which you can request not to receive further communications of this nature, such as an unsubscribe button or link.
5. Location data collected by the App
The App is a severe-weather safety product. It accesses your device's location for one purpose only: to warn you when lightning or other severe weather is near you. We never use your location data for advertising, marketing, profiling or analytics unrelated to safety alerting, and we never sell it.
Location while you are using the App
With your permission, the App uses your device's approximate and precise location while the App is in use to determine your current position so that we can assess your proximity to severe-weather hazards and show you relevant alert information.
Background location - the optional Personal Mobile Safety feature
The App offers an optional safety feature (Personal Mobile Safety) that, when you expressly enable it, collects your device's precise location in the background - including when the App is closed or not in use - so that we can continue to warn you when lightning approaches your position as you move. This feature:
- is strictly opt-in - it is only activated after you accept an in-App prompt and grant the relevant operating system location permissions ("Allow all the time" on Android, "Always" on iOS);
- is movement-based to protect your battery and minimise collection - the App generally captures a new position only when your device moves a significant distance from its last reported position, or when our service requests a position refresh ahead of approaching severe weather; and
- can be turned off by you at any time in the App's profile settings or by revoking the location permission in your device settings. Disabling the feature stops background collection and deletes location data stored on your device; signing out of the App does the same.
What location information is collected
Each position report sent to us consists of your device's latitude and longitude together with the reading's accuracy, altitude, speed, heading and the time it was captured, and is associated with your account and a device identifier so alerts can be delivered to the correct device.
How location data is transmitted, stored and shared
Position reports are transmitted to our servers over an encrypted (HTTPS/TLS) connection and are protected in accordance with section 6 of this policy. We use them solely to operate the safety-alerting service. Location data is disclosed only to the service providers who assist us in hosting and operating that service; it is not disclosed to any other third party, and it is never sold or shared for advertising purposes. We retain location data only for as long as reasonably necessary to operate the safety-alerting service, after which it is deleted or de-identified.
You may request access to, correction of, or deletion of the location data we hold about you at any time by contacting us at the address set out at the bottom of this policy.
6. Security, access and correction
We store your Personal Information in a way that reasonably protects it from unauthorised access, misuse, modification or disclosure. When we no longer require your Personal Information for the purpose for which we obtained it, we will take reasonable steps to destroy and anonymise or de-identify it. Most of the Personal Information that is stored in our client files and records will be kept for a maximum of 7 years to fulfil our record keeping obligations.
The Australian Privacy Principles:
- permit you to obtain access to the Personal Information we hold about you in certain circumstances (Australian Privacy Principle 12); and
- allow you to correct inaccurate Personal Information subject to certain exceptions (Australian Privacy Principle 13).

In the event of a data breach affecting your Personal Information, we will respond in accordance with the Notifiable Data Breaches scheme under the Privacy Act. Where a breach is likely to result in serious harm to any individual whose Personal Information is involved, we will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable.
7. Complaint procedure
If you have a complaint concerning the manner in which we maintain the privacy of your Personal Information, please contact us using the contact details set out at the bottom of this policy. All complaints will be considered by staff and we may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.
8. Overseas transfer
Your Personal Information will not be disclosed to recipients outside Australia unless you expressly request us to do so. If you request us to transfer your Personal Information to an overseas recipient, the overseas recipient will not be required to comply with the Australian Privacy Principles and we will not be liable for any mishandling of your information in such circumstances.
